CAR RENTAL AGREEMENT TERMS AND CONDITIONS

Under this Agreement, the LESSOR leases the specified vehicle (hereinafter "the Vehicle") to the LESSEE according to these rental terms. The minimum (chargeable) rental period is 24 hours (one day).

The Lessee and Lessor are hereinafter collectively referred to as "the Parties".

By signing this Car Rental Agreement, the LESSEE declares and confirms awareness that all personal data specified in the agreement is used exclusively for fulfilling the Car Rental Agreement. The LESSOR undertakes to store and process personal data obtained from the LESSEE in compliance with the EU General Data Protection Regulation (GDPR) No. 2016/679.

1. SUBJECT OF THE AGREEMENT

1.1. Through this Agreement, the LESSOR, whose primary business is car rental, undertakes to provide the Vehicle to the LESSEE for temporary use against payment, while the LESSEE undertakes to pay rental fees and other applicable charges and/or penalties for breach of agreement terms.

1.2. Before concluding the Rental Agreement, the LESSEE must present to the LESSOR: a valid passport or national ID card, and a valid driver's license permitting operation of the rented Vehicle. These requirements also apply to authorized representatives of legal entities.

1.3. If the LESSEE wishes to register an additional driver authorized to operate the rented Vehicle, they must provide the LESSOR with: the additional driver's full name, date of birth, personal code (if applicable), passport number, driver's license number, and driving experience. The LESSEE unconditionally assumes full responsibility for any breaches of agreement terms by additional drivers.

1.4. Only persons specified in the Agreement may operate the Vehicle. Violation of this condition makes the LESSEE fully liable for all damages and consequences related to Vehicle use.

2. VEHICLE COLLECTION AND RETURN

2.1. When signing the Agreement, the LESSEE confirms: acceptance of service fees and all agreement terms, receipt of the Vehicle in good technical condition with all accessories, documents (technical passport, insurance policy), and keys.

2.2. The LESSEE must return the Vehicle in the same technical condition and completeness as received. The Vehicle must be collected/returned at the specified time and location.

2.3. Unless otherwise agreed, the Vehicle is rented with a full fuel tank. Upon return, the LESSEE must refuel to the same level or not less than specified in the Agreement.

2.4. If returning a dirty Vehicle, the LESSEE agrees that hidden damages may be identified after washing within 1 business day (Monday-Friday). For vehicles returned abroad or outside business hours, damages must be identified within 3 days post-return.

3. VEHICLE USE

3.1. The LESSEE must visually inspect tires daily before use. Any warning lights (except low fuel) or unusual noises require immediate stop and LESSOR notification. Continued use requires LESSOR approval.

3.2. Repairs may only be conducted at LESSOR-approved service centers after consultation.

3.3. If the Vehicle becomes unusable for over 24 hours due to mechanical failure, accident, or damage not caused by LESSEE, the LESSOR must provide a replacement vehicle within 24 hours under same terms (within Lithuania).

3.4. The LESSEE acknowledges that GPS tracking may be installed for asset protection and agreement enforcement purposes.

4. ACCIDENTS, THEFT, AND OTHER DAMAGES

4.1. In case of accidents, fire, third-party damage, or theft, the LESSEE must: mitigate losses, immediately notify LESSOR (+370-686-00611) and emergency services (112), complete incident reports, and collect witness/police details.

IMPORTANT: Notifications must include damage location, notification details, and perpetrator information (if known).

4.2. Police reports and transport company certificates form the basis for insurance claims and third-party liability claims.

4.3. The LESSEE is prohibited from signing any documents admitting LESSOR liability for damages.

4.4. If accidents/damages occur abroad due to LESSEE fault, no replacement vehicle will be provided abroad. The LESSEE bears all repatriation costs.

5. VEHICLE INSURANCE AND COVERAGE TERMS

5.1. The Vehicle is insured under Lithuanian and EU motor insurance regulations, including: comprehensive (CASCO) insurance, compulsory third-party liability. Driver liability reduction options may be available for additional fee. Liability reduction becomes void for interior damage, tire/wheel/glass damage, or prohibited use cases.

5.2. Insurance becomes void if LESSEE fails to: properly register incidents, complete reports, contact police when required, obtain police certificates, or if keys/documents are stolen with Vehicle. The LESSEE assumes full liability in such cases.

5.3. No insurance compensation applies if authorities confiscate the Vehicle (e.g., DUI offenses). Full liability transfers to LESSEE.

5.4. Insurance EXCLUDES: unreturned documents/keys, irreparable tire/wheel damage, windshield damage, and other cases specified herein.

6. PAYMENT TERMS AND DEPOSIT

6.1. Before Vehicle handover, a security deposit is authorized on LESSEE's credit card, comprising total rental cost + liability fee. For prepaid rentals, only liability fee is authorized.

6.2. Rental price includes: base fee, insurance, maintenance, and other agreed charges.

6.3. The LESSEE unconditionally agrees to pay additional charges for:

6.3.1. Excess mileage (unless otherwise agreed)

6.3.2. Extended rental periods (if mutually agreed)

6.3.3. Fuel shortages at return

6.3.4. Additional services

6.3.5. Damage compensation

6.3.6. Repair costs when Vehicle returned without LESSOR inspection (damage assessment within 1 business day/3 days for foreign returns)

6.3.7. Interior deep-cleaning costs if dry-cleaning insufficient

6.3.8. Penalties for: a) unauthorized countries visited; b) late returns without proper extension procedures

6.4. Late payments incur 0.05% daily interest on outstanding amounts.

7. LIABILITIES AND PENALTIES

7.1. The LESSEE must comply with traffic rules, agreement terms, and Lithuanian laws.

7.2. Returns delayed by 1-24 hours incur full daily charge.

7.3. Returns to wrong locations incur transportation fees to agreed location.

7.4. Full LESSEE liability applies when:

7.4.1. Insurer denies claim due to LESSEE fault

7.4.2. Official dealer refuses warranty repairs due to LESSEE actions

7.4.3. Continued use after noticing abnormalities

7.4.4. Agreement breaches

7.4.5. Using technically unfit Vehicle

7.4.6. Hit-and-run incidents

7.4.7. Using wrong fuel type

7.4.8. Tire/wheel damage

7.4.9. Failure to return keys/documents (7-day rental charge applies during replacement)

7.5. Failure to return Vehicle within 24h of agreement end permits LESSOR to report theft. LESSEE acknowledges criminal liability under Lithuanian Criminal Code Art. 1.8.4(2) and agrees to compensate losses until return.

7.6. LESSEE must cover repair costs within 5 business days of demand for damage caused by their fault.

7.7. LESSEE agrees to compensate all penalties/liabilities without dispute.

7.8. LESSEE confirms that he has read and understood the Damage Pricelist, which is annexed to the Agreement.

7.9. LESSOR is not liable for:

7.9.1. LESSEE losses from Vehicle unavailability (except LESSOR fault or legal requirements)

7.9.2. Items left in Vehicle

7.9.3. Third-party damages caused by LESSEE

7.9.4. Accident consequences to driver/third parties (except LESSOR fault or legal requirements)

8. TERMINATION AND EXTENSION

8.1. LESSOR may unilaterally terminate if:

8.1.1. LESSEE materially breaches terms

8.1.2. LESSEE bankruptcy/insolvency proceedings commence

8.2. Agreement extension requires mutual consent.

8.3. Extensions require written confirmation unless otherwise agreed.

8.4. Late returns incur charges until actual return or full loss compensation.

9. FINAL PROVISIONS

9.1. Executed in 2 Lithuanian-language copies (or other agreed language), one per Party. Lithuanian text prevails in discrepancies.

9.2. Governed by Lithuanian law, with priority to agreement terms.

9.3. Disputes first resolved through negotiations, then via State Consumer Rights Protection Authority (Vilniaus g. 25, Vilnius) or EU ODR platform. Court proceedings under Lithuanian law.

9.4. Amendments require written form and mutual signatures.
